I. CALL TO ORDER
Chairman Plura called the meeting of Zoning Board of Appeals to order at 7:32pm.
II. CORRESPONDENCE:
Carol McClaine read the following notice as posted in the Daily Gazette:
PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Town of Princetown will conduct a hearing on the following proposition on Monday, October 19, 2009 at 7:00pm at the Town Hall at 165 Princetown Plaza:
Mr. Douglas Gray and Ms. Diane Bishop are hereby requesting an area variance for a lot line adjustment on property located at 2923 Pangburn Road, Duanesburg, New York
Tax Map# 69.-2-2 and 69.-2- 4
Chairman Plura asks the secretary if there was any correspondence from the Town of Princetown Planning Board: No.
Chairman Plura asks the secretary if there was any correspondence from the Schenectady County Planning Department: Yes. The Schenectady County Department of Economic Development and Planning defers to local consideration on the area variance.
Chairman Plura asks who is representing this area variance request: Doug Gray of 2923 Pangburn Road would like a lot line adjustment to the adjoining property which is his sisters. His parents passed away and they would like to split the land into approximately two equal lots.
T. Bishop asked if there were any other configurations to divide this property? Doug stated
yes, however putting lots 2 and 3 together in the future might cause a financial hardship and some day he might have to sell one of the lots to be able to live where he is now.
V. Benson stated that the board needs to know what are we examining for this variance. Is it a lot line or road frontage? D. Gray stated it is road frontage with 83' road frontage and a lot line adjustment. And V. Benson aren't we creating a new lot? Attorney Mathes stated if the subdivision is approved and the new lot 3 is created then yes the town has created a principal building right as long as all the other setbacks requirements and there is a potential for two more homes to be built on these properties.
III. BALANCING TEST:

•1. Whether an undesirable change will be produced in the character of the neighborhood or detriment to nearby properties will be created by the granting of the area variance.

•2. Whether the applicant can achieve his goals via a reasonable alternative which does not involve the necessity of an area variance.
Yes, there are other alternatives. Keep lots the same and putting in a road then a variance is not needed.
•3. Whether the requested area variance is substantial.
Yes.
•4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district.
No.
5. Whether the alleged difficulty was self-created, which consideration shall be relevant to the decision of the board of appeals, but shall not necessarily preclude the granting of the area variance.
Yes, because there is alternatives.
IV. PRIVILEGES OF THE FLOOR
Chairman Plura opens the meeting to the public.
Tia Daly of Pangburn Road, her concern is potential density of the neighborhood and concern with a driveway invading her property.
Brian Kennedy of 2801 Pangburn Road stated he doesn't believe it will have any effect on the neighborhood
Homer DeBell of Quackenbush Road stated he doesn't believe it will have any effect on the neighborhood.
Chairman Plura closes the meeting to the public.
M. Hickok makes the motions to approve the area variance

Motion to adjourn the meeting was made by Chairman Plura and seconded by S. Salamone
Motion carries 3-2 in favor of the area variance
